Letter Of Intent To Vacate Apartment Please Give Us An Advise... Is It Required By Law To Return The Keys As You Vacate Your Apartment?

Please give us an advise... Is it required by law to return the keys as you vacate your apartment? - letter of intent to vacate apartment

My husband, my friend broke his lease for an apartment complex in Fort Myers, FL last Aug08. That made all the requirements - a letter of intent to leave 1 months, and even paid more than $ 1,000 as penalty. I was with him when he left the place, but it was Sunday and the office was closed so he would not return the keys. With all the things that happened, slipped the return of the key only his head until mid-September, he received a letter accuses him of 427.78 for not returning the keys in the time it was sept25. We wrote a letter requesting the review, but never responded. He is from a collection agency .. sued what should we do?

I think I do not know where is the key now. I find it hard to believe that nothing in the contract is silent on return of keys. often an integral part of the lease. read again and if it really says nothing, then send a formal letter to the owner agrees not to offer the contract for this. even if the collection agency calls again, they should stop, and legally, they should call no more. If they do that, then your husband has a DTPA claim against the collection agency. may be better to send this letter to the owners of a prosecutor.

Oh, something else - if the owner receives from $ 427.78! has the lease provides for this amount? Digitally sign a document relating to the ECyy, which are levied, if he does not return? The owner must, to the number from somewhere, knows where. I think that for any number of keys. Good luck

Not required by law to return the keys, but you must pay for them having to replace the locks. It is too late to be reconsidered. The new locks are available. Sorry friend. Take your licks and move on. There is no appeal. They are quite within their right to collect.

This issue is governed by the lease, not a universal law. Read the lease. If the owner wanted, we might lack the key, not the dwelling shall be interpreted and continue to collect rent until the keys were returned.

They had to pay to change the locks, so you have to pay. He abandoned apartment on Sunday and I just key in an envelope and place in left field. I think they have probably done the same.

Open. Every apartment I've lived, I always put the key in an envelope with the mailbox, and another button (pool, gym, etc.) in the e-mail because they always come only after hours.

Yes, that key is needed to change the locks for the next tenant. At this stage, to pay the tax or do they remain with the collections.
